Proceedings of the Board of Supervisors of the County of Adams
Annual Session, November, 1878

Morning Session
November 15th, 8'oclock A.M. [Continued]
Mr. BURHITE moved that the Board now proceed to elect a County Superintendent of the Poor.  Carried
Mr. HOLMES moved for a recess of ten minutes.  Carried.

Board reassembled.

Mr. REID moved for an informal ballot.  Carried.
Fourteen votes were cast, of which S. P. BERRY had 5, O. B. LAPHAM had 6, CHALMERS 1, J. B. HARRISON 1, 
B. H. POWERS 1.
Mr. HURHITE moved that it take a majority of all the votes cast to elect.  Carried.
Mr. BERRY withdrew his name as a candidate.
A formal ballot was taken, and 17 votes cast, of which O. B. LAPHAM had 8, J. CHALMERS 5, HARRISON 1, 
PIERCE 1, BERRY 1, W. R. NEWTON 1.

A recess of 15 minutes was ordered at the expiration of which the Board reassembled.

Mr. BERRY said that his name having been mentioned in connection with the office of Superintendent of 
the Poor, he, being a member of the County Board, was not eligible unless he resigned his position.  
He should not resign, and at present under no circumstances could he take the office of Superintendent 
of the County Poor.

A motion to proceed to ballot prevailed.

On the second formal ballot 17 votes were cast, of which number O. B. LAPHAM had 8 votes, and L. SCHOONOVER 9.

Mr. L. SCHOONOVER was declared elected.

Mr. EVERHARD moved that Mr. SCHOONOVER be notified of his election.  Carried.

Mr. SCOFIELD moved that the official bond of Mr. SCHOONOVER be fixed at two thousand dollars.  Adopted.

Mr. HOLMES moved that Mr. POWERS be instructed to notify Mr. SCHOONOVER of his election, and confer with him 
as to official bond, &c., and report to this Board next Monday.  Carried.
On motion, the Board adjourned until 1 o'clock P.M.

Afternoon session
November 15th, 1 o'clock P. M.-
The Board met pursuant to adjournment.  Members all present.
Messrs. BURHITE and WATERMAN offered resolutions which were laid over until To-morrow's session.
On motion, the Board adjourned until to-morrow morning at 8 o'clock.

Morning session.
November 16th, 8 0'clock A. M.-
Board met pursuant to adjournment.  Members all present.  Journal of yesterday's proceedings read and approved.
Messrs. AUSTIN and WATERMAN introduced resolutions which were referred to the special committee.
The propositions of Joseph DOW, O. G. RANCK, Chas. GOULD, J. B. McELWAIN, and John SMITH, to purchase county 
lands, were accepted, and the County Clerk ordered to deed the lands applied for upon the terms stated in their 
proposals.

The propositions of WILCOX, Stephen BRUNSON, and Ruel HOTCHKISS, to purchase county lands, were rejected.

On motion, the Board ordered that the County Treasurer is directed to deliver for cancellation tax certificate No. 
1226, of tax sale of 1873, for face value.

Mr. BERRY offered the following.
Resolved.  By the Board of Supervisors of the County of Adams.  That the County Treasurer be directed to surrender 
to the County Clerk, when called for by the Clerk, the certificates against the following described lands:  About 
seven acres on part of NE1/4 NE1/4, and also another piece of about four acres, described in Volume 8 of Deeds, 
page 75; both pieces being on section 13, town 16, range 4.
And further Resolved.  That the County Clerk be, and hereby is directed, to issue tax deeds on the above described 
lands, upon the payment to him of three dollars; and that he is further required to cancel all certificates surrendered 
to him by the Treasurer, without adding any more charges against the purchaser.
Which was adopted.

Mr. WATERMAN moved that the County Clerk be instructed and authorized to purchase 70 cords of 18 inch wood for the 
use of the County offices, and to draw orders on the Treasurer for the payment of the same.

Mr. BURHITE moved to amend by inserting 35 cords instead of 70.  Amendment accepted, and the motion as amended 
carried.

The following resolutions were adopted:--
By Mr BURHITE-
Resolved, By the Board of Supervisors of Adams County, That, whereas, by the Board of Supervisors of Adams County 
in 1874 the following resolution was passed:  "Resolved. By the Board of supervisors of Adams County, that the 
Treasurer of said Adams County be, and he is hereby authorized and instructed to sell and assign any tax certificate 
or tax certificates which now are or hereafter may be in the treasury of said County as the property thereof, to 
such persons as may apply to purchase or have assigned to them any such tax certificates for the principal and 
all accrued interest and cost thereon at the date of such sale or assignment.  Every tax certificate so sold or 
assigned, shall have endorsed thereon the following:

"Assigned to [giving name of assignee.] But this assignment is made upon the express condition, that in consideration 
thereof, if the said certificate shall, on account of any irregularity or illegality in the tax proceedings, be deemed 
or held invalid, the said assignee has, and by his acceptance thereof, does waive the release all claim against said 
County to have the money or any part thereof paid on this assignment paid or refunded to him.

I hereby assent to the terms of the above agreement:

And no tax certificate shall hereafter be sold or assigned to any person who does not assent and agree to the terms 
of the sale and assignment herein set forth therefore.
Resolved, By the Board of Supervisors of Adams County, That the above and forgoing resolution be, and the same is 
hereby repealed.

By Mr. WATERMAN-
The County Board of Supervisors of the County of Adams do order and determines as follows:
That lands sold for unpaid taxes for five successive yearly tax sales, and all certificates of such sales are held 
and owned by the County.  Such land may be redeemed by paying the face of the certificates, advertising and redemption 
fees, and the County Clerk may, and is directed to give redemption receipts on such lands without computing and adding 
interest:  provided, that all certificates against such land, held by the County, be redeemed at one time.
  
On motion, the Board adjourned until November 18, at 1 o'clock P. M.
